No. Forming a nonprofit corporation under state law does not automatically make the organization exempt from federal income tax. Most organizations seeking federal tax-exempt recognition must separately apply to the IRS.
Section 501(c)(3) covers organizations organized and operated exclusively for qualifying purposes such as charitable, religious, educational, scientific, literary, and certain other purposes. Specific organizational and operational requirements apply.
Requirements vary by state. For federal tax-exemption purposes, organizing documents are important, and a corporation’s organizing document is generally its articles of incorporation. Organizations seeking 501(c)(3) recognition must also ensure their organizing documents contain the required provisions.
